Astfel de UTP includ \u00eent\u00e2rzierea pl\u0103\u021bilor, anularea \u00een termen scurt sau modific\u0103ri unilaterale ale condi\u021biilor de furnizare.<\/p>\n<p>Legisla\u021bia UE stabile\u0219te un\u00a0<strong>standard minim de protec\u021bie pentru fermieri \u0219i\u00a0furnizorii<\/strong>\u00a0mici \u0219i mijlocii\u00a0\u00eempotriva UTP-urilor. Statelor membre li sa permis s\u0103 m\u0103reasc\u0103 nivelul de protec\u021bie atunci c\u00e2nd transpun directiva \u00een legisla\u021bia lor na\u021bional\u0103.<\/p>\n<p>Directiva impune statelor membre s\u0103 numeasc\u0103 autorit\u0103\u021bi de aplicare (care pot declan\u0219a investiga\u021bii, pot primi pl\u00e2ngeri \u0219i pot amenda operatorii care \u00eencalc\u0103 legea) \u0219i stabile\u0219te o list\u0103 de\u00a0<a href=\"https:\/\/agriculture.ec.europa.eu\/common-agricultural-policy\/agri-food-supply-chain\/unfair-trading-practices_en\"><strong><span style=\"color: #1e73be;\"><span style=\"color: #ff0000;\">16 practici comerciale neloiale<\/span><\/span><\/strong><\/a>, dintre care:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>10 UTP-uri\u00a0negre\u00a0care sunt \u00eentotdeauna interzise:<\/strong><\/li>\n<\/ul>\n<ol>\n<li>Plata mai tarziu de 30 de zile pentru produse agricole si alimentare perisabile<\/li>\n<li>Plata mai tarziu de 60 de zile pentru alte produse agroalimentare<\/li>\n<li>Anularea comenzilor de produse agroalimentare perisabile \u00een termen scurt<\/li>\n<li>Modificarea unilateral\u0103 a contractului de c\u0103tre cump\u0103r\u0103tor<\/li>\n<li>Pl\u0103\u021bi care nu au leg\u0103tur\u0103 cu o anumit\u0103 tranzac\u021bie<\/li>\n<li>Transferarea riscului de pierdere \u0219i deteriorare c\u0103tre furnizor<\/li>\n<li>Refuzul cererilor furnizorului pentru o confirmare scris\u0103 a unui acord de furnizare de c\u0103tre cump\u0103r\u0103tor<\/li>\n<li>Folosirea gre\u0219it\u0103 a secretelor comerciale de c\u0103tre cump\u0103r\u0103tor<\/li>\n<li>Retalii comerciale din partea cump\u0103r\u0103torului<\/li>\n<li>Transferarea costurilor de examinare a reclama\u021biilor clien\u021bilor c\u0103tre furnizor<\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li><strong>6 UTP-uri\u00a0gri\u00a0care pot fi permise dac\u0103 furnizorul \u0219i cump\u0103r\u0103torul sunt de acord \u00een mod clar \u00een prealabil:<\/strong><\/li>\n<\/ul>\n<ol>\n<li>Returnarea produselor nev\u00e2ndute<\/li>\n<li>Plata furnizorului pentru stocare, afi\u0219are \u0219i listare<\/li>\n<li>Plata furnizorului pentru promovare<\/li>\n<li>Plata furnizorului pentru marketing<\/li>\n<li>Plata furnizorului pentru publicitate<\/li>\n<li>Plata furnizorului pentru personalul cumparatorului, amenajari spatii.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #1e73be;\"><a style=\"color: #1e73be;\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/?uri=CELEX:32019L0633\"><span style=\"color: #ff0000;\">Directiva (UE) 2019\/633<\/span><\/a><\/span>\u00a0privind practicile comerciale neloiale \u00een cadrul lan\u021bului de aprovizionare agricol \u0219i alimentar a fost adoptat\u0103 de Parlamentul European \u0219i Consiliu la 17 aprilie 2019. \u021a\u0103rile UE aveau obliga\u021bia de a transpune directiva \u00een legisla\u021bia na\u021bional\u0103 p\u00e2n\u0103 la 1 mai 2021 \u0219i de a o aplica \u0219ase luni mai t\u00e2rziu.<\/p>\n<p>Aceasta face parte dintr-o agend\u0103 de guvernan\u021b\u0103 mai ampl\u0103, care vizeaz\u0103 realizarea unui lan\u021b de aprovizionare cu alimente mai eficient \u0219i mai echitabil \u0219i care include, de asemenea,\u00a0<a href=\"https:\/\/agriculture.ec.europa.eu\/common-agricultural-policy\/agri-food-supply-chain\/producer-and-interbranch-organisations_ro\"><span style=\"color: #ff0000;\">cooperarea \u00eentre produc\u0103tori<\/span><\/a>\u00a0\u0219i m\u0103suri de sporire a\u00a0<span style=\"color: #1e73be;\"><a style=\"color: #1e73be;\" href=\"https:\/\/agriculture.ec.europa.eu\/common-agricultural-policy\/agri-food-supply-chain\/market-transparency_ro\"><span style=\"color: #ff0000;\">transparen\u021bei pie\u021bei<\/span><\/a><\/span>. Strategia\u00a0<span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/food.ec.europa.eu\/horizontal-topics\/farm-fork-strategy_en\">De la ferm\u0103 la consumator<\/a><\/span>\u00a0este, de asemenea, conceput\u0103 s\u0103 contribuie la \u00eembun\u0103t\u0103\u021birea pozi\u021biei fermierilor \u00een cadrul lan\u021bului de aprovizionare cu alimente.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Principiile-cheie ale directivei<\/strong><\/p>\n<p><em>Protec\u021bia furnizorilor mai slabi \u00eempotriva cump\u0103r\u0103torilor mai puternici<\/em><\/p>\n<p>Directiva prevede protec\u021bia furnizorilor mai slabi \u00eempotriva cump\u0103r\u0103torilor mai puternici, ceea ce include orice furnizor de produse agricole \u0219i alimentare cu o cifr\u0103 de afaceri de p\u00e2n\u0103 \u00een 350 de milioane EUR, cu niveluri diferen\u021biate de protec\u021bie prev\u0103zute sub acest prag. Sunt viza\u021bi fermierii, organiza\u021biile de produc\u0103tori \u0219i distribuitorii situa\u021bi sub prag. Acest lucru se aplic\u0103 \u0219i furnizorilor \u0219i cump\u0103r\u0103torilor din afara UE, cu condi\u021bia ca una dintre p\u0103r\u021bi s\u0103 fie situat\u0103 pe teritoriul UE.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Transpunerea \u00een legisla\u021bia na\u021bional\u0103<\/strong><\/p>\n<p>Atunci c\u00e2nd transpun directiva \u00een legisla\u021bia lor na\u021bional\u0103, \u021b\u0103rile UE ar putea alege s\u0103 fie mai stricte dec\u00e2t prevede directiva \u0219i s\u0103 extind\u0103 domeniul s\u0103u de aplicare. Totu\u0219i, ele nu pot oferi mai pu\u021bin\u0103 protec\u021bie dec\u00e2t cea prev\u0103zut\u0103 de directiv\u0103.<\/p>\n<p>Comisia a publicat \u00een octombrie 2021 un\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/?uri=CELEX:52021DC0652\"><span style=\"color: #ff0000;\">raport intermediar privind stadiul transpunerii \u0219i aplic\u0103rii directivei<\/span><\/a>. P\u00e2n\u0103 \u00een decembrie\u00a02022, toate statele membre transpuseser\u0103 aceast\u0103 directiv\u0103 \u00een\u00a0<span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/NIM\/?uri=CELEX:32019L0633\">legisla\u021bia lor na\u021bional\u0103<\/a><\/span>. \u00cen aprilie 2024, s-a publicat un\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=COM:2024:176:FIN\"><span style=\"color: #ff0000;\">raport<\/span><\/a>\u00a0actualizat, \u00eenso\u021bit de un\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=SWD:2024:106:REV1\"><span style=\"color: #ff0000;\">document de lucru conex al serviciilor Comisiei<\/span><\/a>, care ofer\u0103 informa\u021bii cu privire la op\u021biunile celor 27 de state membre \u00een ceea ce prive\u0219te transpunerea.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Autorit\u0103\u021bile de asigurare a respect\u0103rii legii<\/strong><\/p>\n<p>Fiecare \u021bar\u0103 din UE a desemnat o autoritate competent\u0103 care s\u0103 asigure respectarea acestor norme.
